Kristen Lloyd, Senior Associate 

 

Kristen is an experienced litigator with a focus on civil litigation, investigations, and government enforcement. She represents companies and individuals in a broad range of industries at all stages of litigation, including initial investigation, discovery, motion practice, trial, and appeal. Her practice spans many jurisdictions and subject areas, with a particular focus on antitrust and competition. Kristen works tirelessly to advocate for her clients’ interests and achieve the best possible outcomes.

 

Before joining Bourelly, George + Brodey, Kristen spent eight years as an antitrust and litigation associate in the Washington, DC offices of two international law firms. There, she represented clients in complex multidistrict litigations, consumer class actions, DOJ and FTC investigations, consumer protection matters, complex merger reviews, and antitrust compliance counseling.

 

Kristen lives in Massachusetts with her husband and two daughters.

Representative Legal Matters

 

Civil Litigation

  • Represented a major luxury fashion brand against a no poach class action. Defendants’ motion to dismiss was granted and the Second Circuit affirmed.   

  • Represented a US environmental data provider against antitrust counterclaims and resolved the claims with a favorable settlement.

  • Represented a large US medical company against antitrust and trade secret allegations. Defendant’s motion to dismiss was granted and the Fifth Circuit affirmed.

  • Represented a technology company in arbitration dispute alleging antitrust claims resulting in dismissal of the antitrust claims.

  • Counsel for a manufacturer in In re: Concrete and Cement Additives Antitrust Litigation in the Southern District of New York alleging price fixing claims.

  • Counsel for a Japanese suspension assemblies manufacturer in In re: Hard Disk Drive Suspension Assemblies Antitrust Litigation (MDL 2918) in the Northern District of California alleging price-fixing claims.

  • Counsel for Zydus Pharmaceuticals in an action brought in New Jersey federal court alleging sham litigation.

 

Government Enforcement

  • Counsel for a securities company before the Department of Justice Antitrust Division resulting in a grant of conditional leniency.

  • Trial counsel for Patterson Companies, Inc. in a Part 3 administrative trial brought by the FTC and four related “follow-on” federal court cases alleging price fixing and group boycotts. Two of the putative class actions were dismissed, two resulted in favorable settlement, and the FTC lawsuit was resolved following an 8-week trial with no monetary penalty or independent monitor.

  • Advised companies on compliance with third party subpoenas and trial testimony related to government investigations and litigations.

  • Defended a Fortune 50 client in a complex DOJ investigation into whether the client's participation in an industry-wide trade association standard-setting effort constituted a conspiracy to boycott emerging technologies which the DOJ closed with no enforcement action.

  • Defended medical supply company against criminal investigation by US Attorney's Office relating to sales of restricted pharmaceutical products and related practices.
